SC allows Amazon’s appeal, sets aside order imposing Rs 202 cr penalty

NEW DELHI, May 27: In a relief to Amazon, the Supreme Court on Wednesday set aside an order that had imposed a Rs 202 crore penalty on the US e-commerce giant and suspended its deal with Future Coupons Pvt Ltd.

The apex court allowed the appeal filed by Amazon.com NV Investment Holdings LLC, a direct subsidiary of Amazon. com Inc, challenging a June 13, 2022 order of the National Company Law Appellate Tribunal (NCLAT).

The NCLAT had rejected Amazon’s appeal against an anti- trust suspension of its investment deal with Future Group, saying the retailer had not made full disclosures at the time of seeking approval. A bench of Justices Vikram Nath and Sandeep Mehta also set aside the Competition Commission of India’s (CCI) December 17, 2021 order which had levied the penalty on Amazon and suspended its deal with Future.

“The impugned judgment dated June 13, 2022 passed by the NCLAT and the order dated December 17, 2021 passed by the CCI are set aside,” the bench said.

The top court said if any amount was deposited or re- covered from Amazon pursuant to these orders, the same be refunded within eight weeks. It said the CCI’s authority is “statutory” and its actions must satisfy the minimum standards of legality, fairness and reasoned decision-making that apply to all public authorities.

Unified regulation for pvt nursing institutions

SHILLONG, May 27: The Meghalaya government has introduced a unified regulatory framework for private nursing institutions to standardise infrastructure, regulate fee structures, and improve employability for graduates.

According to a notification issued by the Health and Family Welfare Department on May 27, all private nursing schools and colleges will now fall under a structured monitoring mechanism managed by the Directorate of Medical Education and Research.

The move follows a significant increase in private nursing institutions over the last decade, raising concerns regarding faculty quality, clinical training facilities, and transparency in admissions and fees.

The new framework establishes a single-window system for approvals and monitoring, ensuring compliance with both Indian Nursing Council (INC) and Meghalaya Nursing Council (MNC) norms. To oversee this, the government will constitute the Meghalaya Nursing Education Regulation Authority (MeNERA), a statutory body empowered to grant approvals, conduct inspections, and enforce educational standards.

Approval and admission

Institutions must follow a multi-stage approval process, starting with an Essentiality Certificate from the Health Department based on need assessment. This is followed by recognition from the MNC and INC, and academic affiliation with a university before seats are included in the state’s admission matrix.

Admissions will be centralised and merit-based, with entrance examinations conducted by the Directorate of Medical Education and Research.

Fee regulation and accountability

To protect students from financial exploitation, fees will be governed by a State Fee Fixation Committee, which will prescribe annual ceilings. The government has strictly prohibited capitation fees and multi-year upfront fee collections.

Institutions are required to publicly disclose their approval status, fee structures, and inspection reports. Violations may result in corrective action plans, reduction in student intake, or withdrawal of recognition.

Focus on employability

In a move to boost job prospects, the government has made it mandatory for every institution to establish a Placement and Career Guidance Cell.

Institutions must also maintain links with hospitals and NGOs for practical exposure. The framework further provides for annual state-level nursing job fairs and a graduate tracking system to monitor employment outcomes.

The regulatory framework will be implemented in phases, with immediate enforcement of baseline standards and inspection mechanisms.

Rotary Club hosts inter-school quiz

SHILLONG, May 27: Ferrando Secondary School secured both the first and third prizes at an an inter-school quiz competition organised by the Rotary Club of Shillong for the Umroi-Bhoirymbong area on Wednesday.

Held at the Umroi Presbyterian HS School hall, the event featured 16 teams from eight local schools. While Ferrando Secondary School claimed the top and third spots, Holy Angel Secondary School bagged the second prize. The quiz was conducted by Siddharth Sarki as part of the Rotary Club’s initiative to provide competitive exposure to students in semi-urban and rural areas.

Bihar Speaker on study tour in Meghalaya

SHILLONG, May 27: Speaker of the Bihar Legislative Assembly, Prem Kumar, is currently in Meghalaya on an official study tour aimed at examining legislative functioning and parliamentary activities in the state.

Kumar arrived in Shillong on Tuesday and will remain in Meghalaya until May 29.

The visit forms part of a parliamentary exchange and learning programme intended to facilitate the study of parliamentary practices in Shillong and Sohra, along with visits to places of historical and cultural significance.

Kumar is accompanied by his spouse, Prabhawati Devi, besides officials and security personnel from the Bihar Legislative Assembly.

Byju’s founder sentenced to jail in Singapore, says order is ‘procedural’

NEW DELHI, May 27: A Singapore court sentenced Byju Raveendran, founder of Byju’s, to six months in jail for contempt of court over alleged non-compliance with disclosure orders, but the entrepreneur said the ruling was “procedural” and that he plans to appeal.

The ruling marks the most serious legal setback yet for the founder of Byju’s, once one of India’s most valuable startups, which has been battling investor disputes, debt litigation and operational turmoil following a sharp post-pandemic downturn.

The court ordered Raveendran to surrender himself to authorities, pay legal costs of Singapore dollar 90,000 (USD 70,500) and produce documents relating to his ownership of Beeaar Investco Pte, a Singapore entity that held shares in an affiliated company.

It was not immediately clear whether Raveendran was in Singapore at the time of the order.

His lawyers said they are contemplating an appeal against the decision and applying for a stay of the order.

The case was brought by a subsidiary of Qatar Investment Authority, which invested in Byju’s during a funding round as the company was grappling with lay-offs and mounting financial pressure.
